ICC Fast-Tracks Removal Of Chief Prosecutor Karim Khan: Report
The new framework drops traditional safeguards as Khan faces punitive US sanctions over arrest warrants issued against Israeli officials
The executive body of the International Criminal Court (ICC) has overhauled its internal protocol and “lowered the threshold” for the potential dismissal of Chief Prosecutor Karim Khan, Middle East Eye (MEE) reported on 3 July.
During a meeting on Monday, the bureau approved a transition from a two-stage voting process to a single vote. Under the previous framework, the Assembly of States Parties to the Rome Statute first had to determine whether misconduct occurred by a two-thirds majority, before a separate removal vote requiring an absolute majority of 63 votes could be triggered.
Lawyers from the London-based firm Carter-Ruck, representing Khan, stated they were not notified of the change, and noted the decision deviates from the bureau’s own written procedures.
“It removes the Assembly’s separate and prior determination, under rule 29, of whether serious misconduct occurred at all,” the lawyers told MEE.
They added that the move “reduces the threshold for a finding of serious misconduct from the two-thirds majority provided in that procedure to a bare absolute majority.”
